Scope of the general conditions of sale
These conditions apply to the sale of products from FG Xport partner producers and marketed by FG Xport, on its shop accessible via the Internet. They are automatically made available to the buyer on the home page of the website https://www.bestwinexport.com.
It suffices for the buyer to click on “General Conditions of Sale” (hereinafter referred to as GTC) to know the conditions of his order, even before he has started the ordering process. Consequently, the fact of placing an order implies the buyer’s full and unreserved acceptance of these T & Cs, to the exclusion of all other documents such as prospectuses, catalogs or e-mailings issued by the seller and which have not only an indicative value.
The fact that the seller does not avail himself at a given time of any of the provisions of these conditions cannot be interpreted as a waiver of his subsequent reliance on any of the aforementioned conditions.
Accounts and orders
Registration (Not yet available)
Steps to create an account:

Orders
To place an order, the buyer must first have registered with FG Xport according to the terms and conditions mentioned above.
Once registered, the buyer can order on the site https://www.bestwinexport.com using their username and password.
It is specified that FG Xport reserves the right not to act on the order placed by the buyer:
- You must be professional and have a DUNS number (company identification)
- In the event of orders exceeding, by their content or frequency, the needs of a non-professional and more generally in the event of an abnormal request or bad faith from the buyer
- In the event of information coming from the banking organization in charge by FG Xport of the management of the payment of the order indicating the impossibility of implementing the means of payment of the purchaser
- And more generally in the case of a legitimate reason as provided for by article L-122-1 of the Consumer Code
In this case, FG Xport will inform the buyer by email.
Sales of goods and services
Our offers are exclusively reserved for professional customers (distributors / resellers, restaurants, clubs, bars, etc.) and limited to Japanese territory (from France to Japan).
Our offers are valid subject to typographical or display errors, and while stocks last.
Orders are confirmed by sending the invoice but are not final until receipt of full payment.

The products featured on our site are a limited time promotion.
Once the promotion date for this product has passed, it will still be available for purchase on the site’s store thereafter but without the current price promotion (this part will be available in a future update of our website).
Availability
The indications concerning the availability of the products are provided by FG Xport to the purchaser when the purchaser places the order, but if it is noted the unavailability of a product after validation of the order by the buyer, FG Xport will inform him by email as soon as he becomes aware of it.
In such circumstances and if the offer is made to him by FG Xport, the buyer may opt for the supply of a product of equivalent quality and price or, where applicable, exercise his right of withdrawal on this order from by FG Xport.
Minimum quantity and packaging

We offer our customers two types of boxes / cases:

Minimum quantity of bottles per order
For reasons of transport cost, the minimum number of bottles for an order is 500.
Our prices are decreasing and are calculated automatically by our algorithm according to the quantity ordered. And it varies depending on the number of pallets / containers needed.

Delivery and deadlines
Deliveries are made by the carrier from the address of the producer, in France, to the address indicated by the customer at the time of the order and located in Japan.
Given the complexity of the transport (distance, sea transport, etc.), the average delivery time is 30 to 60 days from receipt of payment or bank authorization (online payment by credit card).
The export of products is subcontracted to our partners and carried out under their responsibility.
If this is the case, FG Xport will reimburse the buyer as soon as possible and at the latest within 30 days of the date on which this right was exercised. Beyond that, the amount due will automatically be productive of interest at the legal rate in force. At FG Xport’s proposal, the buyer may however opt for an exchange.
Price and payment
Payment methods
We accept the following payment methods on this site:

- PayPal
- Bank transfer (in the case of an order by email)
When you provide us with your payment information, you confirm to us that you have authorized the use and access to the payment instrument you have chosen to use. By providing us with your payment details, you confirm that you authorize us to charge the amount due to this payment instrument.
If we believe that your payment has violated any law or any of our terms of service, we reserve the right to cancel your transaction.
Prices and rules
All prices are indicated in Yen (jpy) HT, and include a package including all costs necessary for delivery.
The price of the items ordered is payable in full to FG Xport as soon as your order form is issued on the site, by secure payment by PayPal or by credit card via the PayPal platform. The payment part is secure and managed by PayPal. We do not receive any banking information on our site https://www.bestwinexport.com, everything is handled by PayPal. Thus, no confidential information circulates on our network.
Transport and delivery
Responsibilities
When you make a purchase from our site, you agree and agree to provide a valid email and shipping address for the order. We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your method of payment.
While we aim to provide you with an accurate estimate of shipping times and costs, these may vary due to unforeseen circumstances.

In the event of problems
In the event of breakage or damage during the preparation of the order or the delivery, which will have been the subject of the above reservations, FG Xport may deliver to you again, or reimburse you for the products damaged.
Retention of title
Until the actual and full payment of the price, the supplier remains the owner of the goods sold. Full payment will be equivalent to transfer of ownership, but the buyer will, however, become responsible for the items upon delivery, transfer of possession being transfer of risk.
Proof and archiving
By express agreement between the parties, e-mails shall prevail between the parties as well as the data recorded by the automatic recording systems used on the website, in particular as regards the subject and date of the order. The site has an interface on which the parties can consult and download documents such as purchase orders, invoices, … (under development and will be available in a future update). This information is stored in the site database.

Limitation of Liability
FG Xport will not be liable for any problems arising from any improper use of this site. FG Xport cannot be held liable even for aggravated fault and limited to direct damage to the exclusion of any indirect damage.
Indemnity
As a user, you hereby indemnify FG Xport from any liability, cost, cause of action, damage or expense arising out of your use of this site or your violation of the one of the provisions set out in this document.
Applicable law
THIS CONTRACT IS SUBJECT TO FRENCH LAW.
This document is subject to the laws applicable in France and aims to comply with its necessary rules and regulations. This includes the EU-wide regulations set out in the GDPR. The standard is also valid for Japan.
Jurisdiction
ANY LITIGATION ARISING FROM THIS CONTRACT WILL BE SUBJECT TO FRENCH COURTS.
Language
This contract is drawn up in French. It is translated into English, possibly into Japanese, but only the French version prevails.
Severability
If at any time any of the provisions set forth in this document is found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from this document. All other provisions will not be affected by the invalidity and the rest of the document will still be considered valid.
